1) Acceptance of These Terms
By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not
agree, do not use the Service.
Age requirement: The Service is intended for users aged 17+. If you are
under 17, you may not use the Service.
3) The Service
Curasta helps you declutter and organize items (such as clothes, bags, cosmetics, and accessories). You can
record items (including photos), track usage, and receive recommendations and insights intended to support
mindful decluttering.
4) Accounts
- Registration: You may need to create an account and provide accurate information.
- Security: You are responsible for keeping your credentials confidential and secure.
5) Your Content and Permissions
User Content includes photos, item details, notes, usage information, and messages you
send to support. You retain ownership of your User Content.
You grant Curasta a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce,
process, and display your User Content solely to provide, operate, maintain, and improve the Service and to
provide customer support.
AI / Automated analysis: If you choose to upload photos or text for analysis, you instruct
us to process that content to generate outputs (e.g., recommendations). We do not perform facial
recognition and do not create biometric identifiers/templates. Analysis input content is deleted
immediately after processing is completed (or as soon as technically feasible).
6) Acceptable Use
You agree not to:
- Use the Service in violation of any applicable law or regulation
- Upload content you do not have the right to use
- Reverse engineer, interfere with, or disrupt the Service
- Bypass security or access controls
- Transmit malware, spam, or abusive content
7) Recommendations Are Not Guarantees
Recommendations and insights are for informational purposes only. They may be based on automated analysis
and your inputs. You are responsible for your decisions and actions, and Curasta does not guarantee
outcomes.
8) Privacy
Our collection and use of personal information is described in our Privacy Policy. For deployment reasons,
the Privacy Policy may be hosted separately. By using the Service, you acknowledge that we may process
information as described there.
9) Third-Party Services
The Service may rely on third-party infrastructure or tools (for example, hosting or diagnostics). We are
not responsible for third-party services outside our control. Your use of the App Store is also subject to
Apple's terms and policies.
10) Purchases (If Available)
Curasta may offer paid features or subscriptions. If you purchase through the App Store, billing and
refunds are handled by Apple under their terms. Any pricing, renewal, and cancellation terms will be shown
at the time of purchase.
11) Termination and Account Deletion
You may stop using the Service at any time. We may suspend or terminate access if you materially violate
these Terms or to protect the Service and users. Account deletion and retention are handled as described in
the Privacy Policy.
12) Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY
LAW, CURASTA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE
SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURASTA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO
YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
To the maximum extent permitted by law, Curasta's total liability will not exceed the amount you paid to
Curasta for the Service in the 12 months before the event giving rise to the claim (or, if you paid
nothing, 100 USD or the equivalent in your local currency).
14) Indemnification
You agree to indemnify and hold harmless Curasta from and against claims, liabilities, damages, losses, and
expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your
violation of these Terms.
15) Governing Law and Dispute Resolution (Binding Arbitration)
These Terms are governed by the laws of Curasta's principal place of business, excluding conflict-of-law
rules. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding
arbitration, as permitted by applicable law, rather than in court. The arbitration may be conducted in a
reasonably convenient location or remotely, and the arbitrator's decision will be final and binding.
16) Changes to These Terms
We may update these Terms from time to time. We will update the Effective Date above when changes take
effect. Continued use after the effective date means you accept the updated Terms, to the extent permitted
by law.
